General conditions of sale for BEMOOV small bikes

Art 1- Introduction

BEMOOV is the trade name of Roll & Co srl, which operates the site www.bemoovbikes.be and any other related site.

All our sales are subject to our terms and conditions.

Any buyer who places an order through our distribution channels accepts the accompanying regulations, without restriction or reservation.

Art 2- THE ORDER CONTRACT

The buyer has the option of placing orders via our website.

Orders on our site will only be accepted if the buyer has correctly input all requested information.

Our database gives the buyer the opportunity to know the essential characteristics of the product he/she wishes to order.

The photos and technical sheets of the products are not contractual and are in no way binding for our company.

Offers are only valid while stocks last.

When the buyer has registered the order, the buyer accepts all the general terms and conditions without any reservations as regards the price, the product, the warranty conditions, the delivery conditions, etc.

All contractual data is recorded on BEMOOV's servers and can be viewed by the buyer after logging in with the personal access codes, provided that the buyer has created an account.

Art 3 - Price

All the current prices are those which will be concluded when the order is placed. These prices are listed including VAT throughout the site, according to the exchange rate in force in the countries of the European Economic Area.

The price of transport is not included in that of the product. Shipping will be added to the final price and will be clearly indicated to the buyer during the process of ordering online. The buyer will be free to choose the most suitable shipping method from a proposed list, if applicable.

Art 4 - Payment

When you confirm your order, you will be able to choose several online payment methods and all of them are fully secure and encrypted by MultiSafePay, with no data passing through our site.

Unless we inform you otherwise, all products purchased are payable in full prior to shipment.

Art 5 - Shipping

The packages are stored in our warehouse in Belgium and are dispatched every day to destinations in Europe.

The delivery period starts from the first working day following the validation of the order; it will take two working days for reach a Benelux address and four working days for France, excluding Corsica. These timelines are estimations and may vary during periods of high volumn in transport such as holidays, sales, vacation times, strikes, etc.

All packages leaving our warehouse are in good condition and have been quality controlled.

It is the customer's responsibility, upon receipt of the package, to make any claims with the delivery person if the product is not correct or has been damaged. Any complaint regarding the delivery of the product (s) must include supporting photos and reach us by email addressed to our customer service via our website www.bemoovbikes.be, or be posted by registered mail to BEMOOV 15 rue des Phlox at 5100 Naninne Belgium, within 48 hours of having been received. After this period and if no written complaint has reached us, the delivery will be considered as having been definitively accepted.

Under no circumstances can we be held responsible for any delays or destruction of the equipment during transport.

Any complaint about the content of our invoices must reach us in writing within 8 days of the date of the invoice, via our website www.bemoovbikes.be. After this general period and without complaint, the conditions included in our invoices - whether general or special - will be considered as having been definitively accepted.

Art 6 - RIGHT OF CANCELLATION AND RETURN GOODS

All the Products that you have purchased on our site or in our catalog can be returned to us for an exchange or for a refund within fourteen (14) days after the date of receipt of the goods, confirmed by our carrier.

This period starts from the day after the date of delivery of the order. 

The return of the product is at the expense of the buyer, unless there was a shipping error due to our service, in which case we will then bear all the costs of returning and reshipping the product ordered.

The buyer who wishes to return a package must log onto our site www.bemoovbikes.be and follow the return or exchange request procedure.

The product must be returned in new condition, not to have been damaged, not to show signs of wear and not to be dirty. The buyer will always remain responsible for any use and / or any degradation of the product that it may have resulted.

Upon return of the product and after verification of the condition of the latter by our service, the refund will be made within ten (10) working days, using the same means of payment as that used by the buyer in the process of the online purchase.

Art 7 - Warranty

The products are subject to a 2-year legal warranty of conformity for goods, which applies only to the original purchaser of the bicycle anywhere in the world.

What is covered:

BEMOOV guarantees the frame, fork and components of each new bicycle, as well as the accessories, for 2 years from the date of original purchase.

What is excluded: 

  1. Any damage resulting from normal wear and tear of the bicycle and accessories, including the results of normal material fatigue. It is the owner's responsibility to inspect his bike before each ride and to change any worn parts.
  2. Any damage, failure, or impairment caused by abuse, neglect, improper repair, improper maintenance, alteration, modification, failure to follow the instructions or warnings in this manual, accident or other abnormal use, excessive or improper, including, but not limited to stunts, jumps, downhill, trial, riding with heavy loads or in any other manner for which the bicycle was not designed.
  3. Any damage or deterioration to the surface finish, aesthetics or appearance of the product, not present at the time of delivery, as well as any damage or incident occurring during races or competitive events. 

Warranty limits: 

BEMOOV will in no case be held liable for any incidental or indirect damage or costs related to its products.

BEMOOV's liability is expressly limited to the repair or replacement of non-conforming goods or, at BEMOOV's election, to reimbursement of an amount equal to the purchase price of the defective product.

In the event of a warranty claim, the buyer must contact our after-sales service via our website www.bemoovbikes.be and follow the procedure indicated.

As soon as the product has been received in our warehouse and our after-sales service has checked its malfunction, it will either be repaired by our service or replaced by an equivalent product.

The repair time and the return time may vary depending on the time it takes to obtain spare parts and the transport conditions. We can in no way be held responsible for delays caused by these events outside of our control.

Art - 8 RESPONSIBILITY

We have, whether in the process of ordering, delivery, or others, only an obligation of means. We cannot be held liable for problems encountered on the internet such as service disruption or computer attack, natural disasters, force majeure or any other event beyond our control.

Orders will be shipped by the carrier offered to you and we cannot be held responsible for any delay.

Any risk related to the product will be transferred to you upon delivery, so we decline all responsibility in the event of loss or destruction of the product from the moment the risk is transferred to you.

Art - 9 Data Protection

The buyer's order data and information is stored on BEMOOV's server (s) in Belgium. It is always available to the buyer when the buyer logs into his/her account with his/her authentication data.

Art – 10 APPLICABLE LAW AND JURISDICTION

These conditions are concluded between, on the one hand BEMOOV (Roll & Co srl) 15 rue des Phlox at 5100 Naninne Belgium, intra-community VAT number BE0743.808.866 with the site www.bemoov-bikes.com, and any other related site, and on the other hand the buyer.

All conditions are subject to Belgian law.

In the context of out-of-court settlement of disputes in Belgium, the Consumer Mediation Service set up by the federal government is competent to receive any request for out-of-court settlement of consumer disputes. This service will either process the request itself or forward it to the qualified entity. In the event of a cross-border dispute, you can appeal to the European Union's “Online Dispute Resolution” platform via the link: http://ec.europa.eu/odr”.

In the event of a legal dispute, Belgian law applies, only the courts of Namur in Belgium being competent.
